Yes, but github mirror doesn't contain all hacks. In case of cakes it does, yes
It covers everything which uses CakeHax, so Cakes, rxTools, ReiNand, all of d0k3's tools.
i feel as i'm doing something wrong...

i have dropped all the files into the right spot but i'm still getting a failed to load firm message when i load up cakesFW 138

am i doing something wrong?
You need to specify more info on your setup. Which entrypoint/firmware are you using? Browser, MSET, a9lhax?

im currently running 9.2.0-20u (o3ds), i'm trying to install via hombrew launcher (gridlauncher?) i used the browser hack to start this ball of wax going

and i'm using this guide https://github.com/Plailect/Guide/wiki/Part-3-(EmuNAND) (im at step 16)

That's only failing to load AGB_FIRM. It's completely optional, and doesn't actually accomplish anything in Cakes atm since there's no patches written for it. You can safely ignore it, Cakes should still work fine.

So I have what I assume is the latest version of Cakes (it says 138 on the boot screen), but I can't start Smash 1.1.15. With the "survive reboots" patch off, it gives a critical error forcing a manual shutdown, if it's on, it gives a black screen. What do ?

Have you tried to repair/reinstall the game? Also you'll need reboot patches for it, so keep it on if you want to play Smash.
 
But it doesn't prompt me to do so. That, or I don't know how.

EDIT : Unless : since I use a US RF game on an EU 2DS, does that mean that because the ToS don't match, it refuses to do it ?

Well, I was taking a guess here, because eShop asks you to agree with the online terms and so does the System Settings when you connect/update your system. :unsure:
I'm going to take another guess here about your setup:
European 3DS running latest FW(10.7-33E or something like that)
European Smash CIA + updates + DLC
Is that right?

Close as I said about, Smash is US, patched region free. Mainly to not deal with Sonic's absolutely horrible french voice, and the much better US announcer.

Hmm, that might be the issue, I'm not 100% sure, but maybe it doesn't work because it uses NNID and they are different/region-locked? I guess you could test this theory by getting the US Nintendo Badge Arcade CIA and see if you get stuck in the ToS too.
