Hacking Refurb 2DS System version?

So AFAIK all new 2ds come with an expoitable firmware, right? I'm planning on replacing my O3DS with a 2ds and get another one for my sister, and I saw it's going for $60 refurbished in Nintendo's site.

Is the system version on those systems the same as if I had bought it new, or do they update them before selling?

You can safely bet they will be updated. It's been 10 months since 9.3 was released.
