so if a person was to get ban does he still get access to there digital games he purchased
Based on the 3 known bans, you'll still have access to your currently downloaded games, updates for those games, and system updates.
Can't redownload games if you delete them.

When your console is banned you can't use the eShop, play games online and add new friends. As mentioned above, it seems that it's still possible to download game updates. But since you can't access the eShop anymore you can't redownload digital purchased games.

Current bans works like this. But maybe in the future, you will not able to download game updates. Nobody know.

Come on, think of this from Nintendo's view. You're a dirty pirating thief in their eyes. They're going to fuck you over as much as they can. They will ban your Switch, ban your account, and if you linked your account on a Switch in the past, and moved it, they'll ban that Switch too. They're probably not going to ban people at first, and just lure people into a sense of comfort, then when Pokemon or Smash releases, and after you paid them 20 dollars, BAM! banned.

I always thought that the reason you could still download updates on banned consoles like PS3/4 is because if an update added some kind of safety (epilepsy)/obscenity patch and my console was banned and I suffered loss because of that then Sony may be open to being sued in some country or other. I'm guessing this is why updates should still work after a ban. All guess work but maybe true?

How'd you come to that conclusion?

You need an account to download games but not updates.

Also reports suggest you can't unlink the account from the console either.
Because if they ban your account you. Ant access digital games as you need to sign in to access them

We said you can't download them anymore.

You don't sign in to play a game, you select a save slot.

You don't need to sign in, you just need the account linked. Even with the account banned, it will still be on your system and linked to it. You seem to not understand how the switch accounts actually work.
As long as the titles were downloaded before you got banned you will still have them
