but right now there trying to stop hacks on there current firmware and not stoping people on lower firmware installing cfw
yes, but if they're already on a lower firmware what can Nintendo do about it? the worst they can do is basically the system update "nag". they can't force older firmware users to update, or have 9.2 detect it's being exploited to run custom firmware, etc.
 
but they could stop you from using cfw on lasted firmware but i don't think they will bother to do it

they'd have to update NATIVE_FIRM or something to do that plus Home Menu/ErrDisp/something important to require the newer FIRM, and when they do it will most likely be patched out.
 
with 11.0 the only thing they really patched was downgrading since smea fixed ninjahax and oothax

the nand space is limted so it will get to the point where they can't add any more features to the 3ds

implying they would still add newer features to the console, a lot of space is leftover in CTRNAND that it's virtually impossible for them to add enough features to fill all of it.

thing is why do different 3ds have different brands and sizes of nand

different manufactures: Samsung and Toshiba. for New3DS, one would be 1.8GB, one would be 1.2GB. regardless of this, only 1.2GB is ever used (i.e. the extra 0.6GB is wasted space). for Old3DS this is about 943MB.

anyway I should have ended this a while ago, this is a waste of time...
