Also, wouldn't this fall under SEGA vs. Accolade?
Sega v. Accolade was for a case where the trademarked name ("SEGA") was required in order to initialize the system. In this case, the Nintendo 3DS logo isn't needed (since it can be changed to "Homebrew").
 
Can you make your own splash? If so, how? Or are you stuck with the "homebrew" splash
reading through this reminds me of what we did back in the psp days. we had some psp themes compatible with the newer cfws (like Pro, TN-HEN) that game with a custom launch screen when you boot up a game. so curious if devs could do something similar and include it in their homebrew

That would apply more to the Game Boy series, where the circled Nintendo is displayed but also verified to be byte accurate - I suspect it's not applicable here since we can indeed have custom logos

Anyway, whether the official logo is indeed copyrighted (threshold of originality) hasn't been proven in a court, did it?
Whereas "circled Nintendo" or Microsoft's current 4 squares are too plain to be copyrighted, at least in the USA

Any game. Preinstalled apps, DSiWare, Virtual console of every main pokemon game ever released (dont worry, I own the cartridges), Omega Ruby, Sun, Mario 3D World. Everything on my 3DS.
As @PokeAcer says, only proper CTR (3ds) games will show it, not DSiWare or GBA virtual console.

Omega Ruby and Sun should do it, thats odd if it's not
