I think that if he is truly planning on writing a 3DS emulator right now, it'll be based on existing documentation and will not include decryption for 3DS games. i.e. will not actually work with commercial games at present (unless someone in the 3DS scene can actually decrypt 3DS games; if so, maybe it'll go the way of the PS3 scene i.e. a mess). Technically, the emulator could possibly be made to "work", but it wouldn't be able to run 3DS games until such time as either (i) the common key is made public or (ii) release groups find a way to decrypt 3DS ROMs and release decrypted versions
Personally, I don't think there's much point doing that right now, but perhaps he just wants to have his emulator virtually finished by the time (i) or (ii) happens, so he can just tweak it a little and have a working emulator, before anyone else who would wait for those things to happen.
