Hacking Original 3ds XL bundle firmware

A game store in my country (EU) has a sale on an original 3ds XL bundle with New Super Mario Bros 2. Is it possible that the firmware will be 9.2 or lower since it's an old 3ds? Is there any way I can check? And will I be able to upgrade it to 9.2?

Or would you recommend to get a New 3ds and wait for the eventual 10.xx firmware hack?

All NIB 2DS,3DS,3DSXL besides the 2DS Yo-Kai Watch bundle will be below 9.2.
