Does this technically mean, that the No$ team have hacked the 3DS, as I guess in order to make an emulator you would have to hack 3ds to know how it works?
No. The OP just assumed this since the 3DS was mentioned in this No$GBA thread:
http://www.ngemu.com/forums/showthread.php?t=156605&page=6

The truth is that Martin Korth hasn't said he is working on a 3DS emulator -- he's still working on No$GBA. He is merely trying get the cart ID from various ROMS by getting people to run an app he made for testing on actual DS hardware. He's wanting someone to test a 3DS cart on a DS to see what happens.

besides if we even crack the roms you need a very fast computer to even run them on the emulator I think PS2 emu required at least 2.8 GHZ and a mid grade video card (512MB or better) and the 3DS would require even higher specs than that

How do you figure?

He doesn't say anything about making a 3DS emulator... title changed.

Hardware emulation accuracy =/= playing ROM's, hence playing ROM's often implies using Anti-AP patches.
To be fair, AP issues show up due to incomplete replication of what's going on in the system. Updating emulators to account for AP (without per-game patches) mean better emulation. No$ fell behind due to a long period of no development, while Nintendo had been putting newer and newer AP into their kits and other devs had made more methods as well.
