I was thinking about snagging a refurbished 3ds off the nintendo site. My question, does the firmware come as if I purchased it new or do they generally already contain updates?

Most likely they would be updated to the latest firmware since they're, well, refurbished 3DSs from Nintendo. But they'll most likely handle better than GameStop's/EBGame's refurbished 3DSs since they're, again, refurbished by Nintendo.
