I really dont mind the design, except that there does appear to be a little too much space around the top screen

If the nub is below the D-pad, like on the PSP, it'll be unbearable for me. The PSP nub is so awkwardly postioned.

The 3D I'm not so sure about. There could be people who can't see it at all, or people who can't stand to look at it... Then there could be problems with the handheld itself. The component that makes the games 3D might break easier, or wear out quickly.
I don't know about you, but even though I want a 3DS, I'll just stick with my DS Lite, since I've got a flash cart.
