Yeah could've been my attempt to use it before the 1.2 update, which didn't start the game.

Another one is possibility is from someone who never updated the firmware, but tried it before and wasn't able to start the game. Question is if that got the ban or not.

so the real test now is

Did ANYONE get banned who only used the migswitch AFTER the firmware update that made it compatible with the Switch 2

Would maybe be people who tried the migswitch (when the games wouldnt load) getting banned
i waited till the firmware was out, but i'm also factory resetting before i let it connect

That could be the factory reset though. My 2nd switch, which I also tested it on both before and after mig update and kept offline is also not banned after a factory reset.

Don't know if it'll get banned soon though. We'll see in a day or two probably.

I waited for the compatibility update from mig before testing, however I have used legally dumped games and have mixed certificates / initial data files, renamed and swapped the XCI files and didn't boot got cart reading errors.

Also tested an known internet copy of certificate and data for a dumped games mario wonder... was online and updated the game.

So far not banned, this was 48 hours ago...

Will keep everyone posted.

that's what i'm attributing it to. my thought process is that the log file or whatever it is that reports to nintendo would get deleted when it gets reset.

Spawnwave commented on his video that his switch that tested MIG without it working has not been banned.
that was before the firmware update to the mig switch and it is not working. right now ii think someone was ban becaus they play game on the mig switch and dump enough to go online with that switch 2 !

Stay offline while use MIG is basically self-ban until you go online and if telemetry is flagged, so your Switch 2 will be banned.

Nintendo treats legal backup copies as piracy.

You would have to do NAND backup and restore to clean state before you use MIG, but NAND backup isn't available on Switch 2 because it is not hacked yet.

Other hacking like JKSV, language translation, cheats that require access to Atmosphere is very low risk due to anti-ban protection (send error codes to SD instead of NAND and block the telemetry or send it to SD), but they don't expand to NSP installation that is very bannable offense.

There are number of questions haven't answered yet, especially if MIG is load without error code logged on NAND and Nintendo rely on error code to discover if it is hacked or not.

Even if your Switch 2 is banned, you can still use MIG to enjoy single player games and it is kinda sucks about keycard games won't play on banned consoles.

As eager some might be to run games they haven't paid for on the switch 2, here's a following list of consequence of your switch 2 becoming restricted from nintendos servers:

1. Literally no cartridge based game (from switch 1) will work; all require a day 1 compatibility update, which you are no longer receiving.
2. Cannot buy games from eshop
3. Cannot receive day 1 updates, or bugfixes, or "game-key-only" downloads from switch2 cartridges
4. Cannot play online anymore

You are essentially soft-bricking your own console.

Guess all of that will be irrelevant when Switch 2 got it's full-fledged CFW in the future like Switch 1 has it now..

Until that time, we can use MIG flashcard on a Switch 2 console/w FW 20.1.1 and enjoying 733 pcs of 'carefully preserved game backup copies', IYKWIM with always on Airplane Mode, and disabled WiFi all the time. :)

No, I'm pretty sure I covered that under point 1.

edit:

perhaps the confusin here is, i am not referring to the firmware update which adds compatibility with switch 1 titles.

Each game from switch 1, has a day 1 update required to function on the switch 2.
