dsi ware has access to nand but an exploitable game that does not need a save to be exploited needs to be found in order to do it with out having another cfw 3ds idk if twl ds games have that but there are some twl games with exploits maybe those could be used but idk if they have nand accessHardware in the sense?

Yeah. System Settings has complete control. More control than what eShop has. I think exploiting System Settings is what will lead to success.I think it has more to do with the fact that most people won't get a hardmod or can't due to the price and if the particular hardmod is even more difficult, then what's the use of following up on it.
The basis of trying to get Arm9/Arm11 access is that you need an exploit, something that is not going to become apparent by looking at eShop, but at actual games themselves to create something like Ninjhax.
Or something that actually requests access from the device itself and gets it, like System Settings perhaps? Similar to ROP back in the day still possible to inject a DS Profile into it.

But DSiWare has equal control as System Settings does. A member "Shubshub" messaged me that the Devs have already made an exploit but they won't release it due to Nintendo & the fact that it'll lead to further piracy.It's not that easy though, that's the point, Homebrew devs have been working almost nonstop to find exploits, and though they've been releasing many secondary exploits, there's only two reasons as to why a public exploit for arm access hasn't been released.
1. They haven't found anything because it's not that easy as many exploits have been patched over the 3DSe's life cycle.
2. They haven't released it due to Nintendo possibly releasing one final update around the time the new 3DS games come out to kill off all exploits/A9LH uses.

well patching its not gonna stop pirates if they really want to do it and have an updated system they will buy a new one or hardmod then downgrade1. Of course it'll lead to piracy, that is the life of an exploit, even if it was released in a way that would not allow pirated games to be installed and then further played. Another dev who was pro-piracy would definitely find a workaround for it.
2. Still probably waiting for the final update, which I can almost assure shall come with so many new games coming. So you better keep your 3DSes with WifiOff for December x3
