Because we can't gather info on how the device even works, everything has a impossible to break encryption. A 3DS hack would have to bypass the encryption process for custom code to be loaded.

The day a functional 3DS emulator comes out could possibly never come.

Because with each passing generation consoles are getting more difficult to hack and emulate.

Usually emulators start being able to run homebrew and then work their way up to retail games. Since the 3DS only runs digitally signed software and hasn't been hacked yet, there's no homebrew yet. Since the games are encrypted you would also have to break past the encryption to be able to see the program itself to be emulated.
