Is Nintendo watching us?

Nintendo have an army of laywers monitoring the web, not just GBAtemp, so in a way yes they are watching us along with the rest of the Internet. I do not think GBAtemp gets special treatment.

We do our best to keep things entirely legal, but if a user posts something which our mod team deems illicit, we do our best to take it down immediately. And if anything gets past our mod filters, we may occasionally receive DMCA complaints, which we comply with - only after verifying that they are valid.

When this happens, the content author will be personally notified, to alert them that their content was taken down. Repeat offenders may get "warns" and other regular enforcement for forum offenses. This doesn't happen very often.

Yeah. I personally believe the TEMP might even have Nintendo related people registered as members.
We might not know who they are, but it's absurd to deny the possibility... I mean... nearly all the Unofficial Software that has been detected in Nintendo consoles "comes" from here, and there's even tutorials on how to circumvent such anti piracy measures. I'm honestly surprised the TEMP hasn't been touched by Nintendo's lawyers yet.
GBATEMP has been very wise to keep out of such troubles.

Almost certainly not. If a newspaper publishes libel, do the victim's lawyers go after people talking about it on Facebook, or the newspaper themselves?
they are looking in to it, but only will take any action if some moron pot a link (or a zelda).

Yes. In fact, @mrmiyamoto is a regular on the board.

This is the real answer.
