Hacking Is it safe?

Well the thing on my mind is that I had pirate- ahem, backed up a bunch of WiiWare/VC games and installed them on my Wii and I was wondering if it was safe to go to the Shop channel to actually legitimately buy games without Nintendo doing anything. I read somewhere that I need IOS 60/61 and I was looking for some clarification.
BTW, I'm running system menu 4.0.

On System Menu 4.0 you have IOS61. And no, they won't mention your stuff... or at least, they don't care about it.
