If I install the homebrew menu NSP, does it come with the same risk of ban as a pirated game?

I would assume so. Simply using CFW would be ban-worthy.

There is a risk yes, but it is safer than piracy simply because the HB nsps use standardcrypto rather than tkey crypto with fake tickets used by most dumps, I have personally not been banned and used custom nsps for months without any issue.
