(Disclaimer: I don't care about pirating on 11.0. I have a9lh, plus im not a pirate ;))
While I am no where near being a developer and don't really have the technical knowledge for this, I think it would need to be done on a game-per-game basis due to each game having different permissions on how they use the 3DS's hardware.

So if you have a game that has totally different permissions compared to the one your trying to patch in, it may cause compatibility issues. Although, this is just my two cents and I don't really know if I'm right or not.

Also, another thing of interest is that HANS has an option to replace the code.bin of games clearly visible on the Menu, but that feature has been proven to not really work with other people from what I heard.

While speculation, maybe Smea realized what it could've done (enabling piracy) and possibly blocked the feature out last minute by making it buggy? Not saying this is likely in the slightest, and I don't really think he did this.

IIRC, it doesn't work due to code.bin replacement needing kernel access.

You can direct those 11.0 owners to someone who can hardmod their 3DS for the "free gaemz"

Thats the price you pay for coming into the homebrew scene so late, and yes it is late asking for an exploit considering 11.0 was only 4 months ago.

It's possible; it's just annoyingly difficult to implement. It's not worth the trouble. And I sure as hell wouldn't help with it.

You just overwrite an existing game's code and read-only data using gspwn, and redirect RomFS reads elsewhere. But it would have to be done on a per-game basis, making this totally not worth it.
This is indeed absolutely not worth the trouble. Knowing that section sizes are different and are per-game/application based, having a game's code.bin work on an app would be difficult and complicated; without ignoring that some games and apps don't have SD access on their own.

tl;dr: It's theoretically possible to do piracy from userland, but it's really really fucking hard and it's probably just easier to find a new arm9 exploit.
 
convert the game to a 3dsx file would be hard hacking to game to have it work as a 3dsx though

Userland piracy is possible in theory but no one wants to do it because it's not worth the trouble (and most devs are anti-piracy anyways)

@LuxerWap we were basically talking about the possibility of a Loadiine-esque system on the 3DS, where we launch one game and replace it with another. The problem is that's far, far harder to do than on the Wii U, and would be needed to be done on a per-game basis.
 
He's wrong. I asked about what he's referring to on #cakey a while back. Basically, the permissions needed for a Loadiine-esque setup are out of userland reach.
We can launch ROM hacks, and we have full control over (non-privileged) process launching. So why can't we slip in entire games? The problem is the code.bin. Replacing that requires privileges that we don't have in userland. Though I don't know the specifics, (or anything about it period) it works on the Wii U because it's not as smart about it. Apparently.
I don't blame you for asking, however ;)
I'm not sure why this was featured when it was proven to be incorrect later.
