The firmware is at 9.9 out of the box. I picked one up last month and it is currently on aureinand with 10.7 emunand.

That is a nice looking 3ds. Shame they didn't have it when I got mine. The hyrule one I got was the only one I could get in about a fifty mile radius at the time (I live in a rural area in some mountains), so I got it before someone else snatched it up.
this was the only one they had in stock @ my GS.. don't remember what version but it was definitely 9.something out the box
