Gaming Hypothetical question about 3DS Ambassador games.

I've heard in passing that if, hypothetically, someone were to install one of the 3DS Ambassador games (such as Minish Cap for example) and play them on a newer model without their NNID being associated with the Ambassador program, Nintendo will detect it and ban you. Is this true?
 
Well...in all honesty the 3DS doesn't have all the shitload of protection unlike its counterpart (the Switch). It may have protection now to keep people from pirating directly from the CDN but that can be diverted just by downloading its CIA file and installing it that way. Otherwise they wont track you or know what your playing and crud. As long as you disabled all the crud like "Automatic Software Downloads" and the Nintendo help thingy.
