So is it possible to use the sx pro software without a licence for homebrew my original switch was returned due to a warranty return the licence was tied to that but can the old dongle still be used to send they payload and the sx software to use homebrew without licence register?

Yes, without the license you can still use the unlicensed version for normal homebrew.
