Misc Going Online with 3DS with CFW

I know there are a million threads on this, and the answer for the most part is yes (you can play pirated games online), but I didn't see an answer for the following.

1. Can I launch homebrew while connected to the Internet and not get banned?

2. Can I play a pirated game online (i.e. Pokemon Sun) and trade legit Pokemon? Can I connect to Nintendo's servers to enter legit Mystery Gift codes? Will these two actions cause bans?

Both of those are yes, you can do so without worries of a ban.
