I'm gunna have to mess around with this. I was unable to enter Mt mode without the card, and you have to hard reset after installing Mt launcher. Also trying to system update an emunand without mt/gateway causes a freeze.

Indeed it requires an existing Emunand right now, but that's being worked on. I tried launching it with both an MT-Emunand (9.5) and a Gateway Emunand (9.2 updating right now) and they work flawlesly.

It was my understanding that while it's planned, it's not being worked on yet. Roxas had a priority list he posted in the thread, which I don't feel like looking for right now but it was something along the lines of
1- Get Smash and Monster Hunter 4U to work because they aren't working right now
2- add region free ability
3- cheat engine/ram editor and screenshots

I think a better shot might be trying to see if the 3ds Eshop works the way the wii one does- rather than checking the version of the system as a whole, it checks the version of the Eshop app installed. That's why, on wii, you can install a .wad file (like .cia files on 3ds) of just the latest shop version and be able to access the shop without updating.
I have heard it checks the version of every single system title making sure it's updated to the latest. Still it should technically be possible to patch the system to spoof the version of every system title. GW just haven't bothered since it's easier (and better) to just release an update to emuNAND so people can continue using the latest firmware.

Oh, well that shows how much attention to dev stuff. It's definitely possible using 3DSNus to download old versions and spoof the version identifier to be the same as the newer one, but at that point you would essentially need to reinstall spoofed versions for every system title. You could do it, but the benefits don't really outweigh the risks of potentially breaking your EmuNAND in my opinion.
