I think black 3DS consoles only come in 5.1, depends on country though. What country are you specifically looking for?

Impossible. Black 3DS XLs will only come on firmwares higher than 4.5. Sorry, bud.

Look on ebay, I'm sure the seller will be more than happy to tell you the firmware version.

Same here. You can try shell swapping, but God help you if something goes wrong.

Wouldn't black/white be incredibly easy? All you need to swap is the top and bottom covers. The worst damage you could do would be ruining the little rubber nubs covering the screws, you shouldn't have to disassemble the system at all
(assuming that the 3DS is disassembled similarly to the DS Lite, where the top and bottom covers are only attached via screws).

Pink 3DS XL already has a white inside and the Red/Blue XLs already have black inside.

A full case swap? Yeah, that's a nightmare. I spent an entire night on it, mainly the ribbon cable that goes from the bottom shell to the top through the top left hinge area, augh.
But if all you need to swap is the top cover and the bottom cover, then it's easy. Unscrew, pop on, done! Inner shell is hell but unnecessary to swap a Blue/Red XL to all-black.

I don't think swapping is that hard,
However you have to take care of connectors, the small plastic thing that fix the ribbon cables in place broke easily...
Otherwise, you could try to get the eu model, because gateway spoof region I believe.

I have bought a new 3DS XL black with 2013 on the bottom.
The 3DS was on 4.5!!!!!!!
