I have a hacked 3ds, I've been able to download updates and such for games with no issues, but was wondering if I'd be able to get onto the eshop still, or if theyll ban me

No. you are fine for using eshop.

Check if you "download Automatic Software" and "Sending usage information" Disabled in Settings and Check In the friends app that you turn off "Show your own online status to friends". Nintendo, though, could always banish you because of something (cfw etc.) The things that I say just decreases the chances that you get a ban. I hope I was able to help you

I know from experience that, yes, you can still buy games from the eShop.

That is one of my favorite things about having a hacked 3ds, you can still do pretty much everything on your 3ds that you could before you hacked it. Like using the eShop still. Long as you don't try to cheat online you don't have anything to worry about.
