Yes, it is safe to access if you have a9lh (and luma3ds(reliable cfw) ) and are on the latest system version.
If you have paid dlc installed, your non-legit ones will be deleting accessing the eshop.
If you never paid for any dlc you're safe.

Only thing that gets deleted are DLC's(were themes also deleted? I think so) other than that its safe
Themes are just home menu DLC, so yeah, they can be deleted
