For everyone else that may read this, if you have a screen protector or some dust particles stuck between the protector and the screen, try cleaning it first. resistive screens can be triggered by any solid object, not just fingers like capacitive screens. and AFAIK 3ds only supports 1 simultaneous touch at the time.
