Hacking Do I need to update? (CFW+HB Problem)

I recently bought a used 3ds with firmware 8.1.0-4U and I was wanting to install CFW and many other utilities on it. However, My only method of accessing the homebrew menu is through OOTHax. When ever I try to enter the homebrew menu, it goes back to the 3ds main menu. OOTHax works fine on my 10.6 3ds so I am assuming it has to do with OOTHax payloads. Here are my questions.
1.) do i need to update to the newest firmware and downgrade it to 9.2?
2.) can i use a different payload with OOTHax to access the homebrew menu?
3.) Or will I need cubic ninja because many guides use that in tutorials?

Just follow this guide. You'll be able to install a CFW and upgrade your sysNand to 9.2 without downgrading from the newest firmware.
