Could ASM-coded NDS homebrew lead us to run ARM9 kernel code on the Nintendo 3DS?

NDS-mode is isolated from 3DS-mode and runs with limited access. It only has access to the regular DS-functions, because it runs on a different firmware. So there's no way to break out of DS mode, but it would be possible to give DS-mode more access from 3DS-mode.
