Hacking Consequences for using a flashcart on a 2DS?

I just received a nice 2DS to replace my beloved DS Lite.
While as a collector I stick to buying legit games, I also happen to be using an R4i flashcart for all the games I cant find (or cant find at a reasonable price...). This worked great until now, but seeing how anything past the DSi is so much more connected, I wanted to know the following:

Will the use of a flashcart get me into any trouble with my (future) Nintendo account? Like if I start playing Pokemon Pearl through a flashcart, can anything happen? Or should I be aware of anything in particular? (other than system updates that could block the flashcart)
 
if you are pirating 3ds games you will be at minor risk if your are using a r4i you will be 100% fine
I'm not interested in piracy, just a temporary way to play a game until I can afford it or until find an actual copy.
Here DS games (especially the ones I want) are very rare (unlike PSP ones...), and eBay or similar sites demand outrageous prices >_<

there is no way you will get banned by using a ds flashcart
so far it didn't happen and it will not happen
nintendo tried to fight ds flashcarts by updating the console firmware to block them, until they just give up (they didn't cared that much anyway)
anyway. DS servers are shutted down and they didn't had checks.. you could play online totally fine with flashcarts

as for 3ds games, this is different (3ds cartridge games got a key) but that requires a 3ds flashcart and it's another story
