What bothers me the most about a EULA is the amount of people who are afraid to challenge it. Whether its due to financial issues or just not wanting to set a bad precedent. We're at the point where companies are so sure of themselves that they'll tack on whatever they want in their agreements and we just go along with it. At some point it'll be challenged. Hopefully sooner than later.

But we don't. Take a PC - if M$ disables your Windwoes, there are alrernative OSes to retain your ability to use the hardware. Gaming consoles are proverbially and literally propeietary pieces of hardware locked to and designed around their niche, specific OS, but are thus cheaper and more limited in their bare function. Take alternative phone OSes - if you buy that Android phone from a mfg that doesn't lock your ability to install other OSes on - you're free to use whatever you want. If you choose Samsungz, you're stuck with their bloat. If you chose to get a JP/US branded phone, you're typically locked out of flashing it by the terms of local cellular carriers, but thus no one put a gun to your head and made you get that shitty ATT or Docomo version of the phone.

You have the power to educate and choose for yourself what you buy with your money.

Once again, its like trying to improve corporate workers' conditions - you won't. Work there or don't, that's within your power.

Honestly, if I were Nintendo, I would just ban the account and the console. But the console ban does make it a problem for the 2nd hand market.

Other way around, rather - ban accounts vs consoles. They're doing it the greedy fucking money grab way, to still try and retain the customer and sell more h/w. If you got a acct ban, and you wanted to play those games again anew, you'd just buy them again. Overall very shiesty maneuvers to ban the h/w because you can just go and do the same shit on different h/w, and primary thing would be online cheats.
