In any case, even if the graphics are, indeed, the same, they could very well be from a collection of graphic templates that are sold legally. Just like many other forms of media -- fonts, music samples, etc. -- graphics can also be sold in sample form for legal use.
That said, changing a color isn't enough to legally call a piece of copyrighted material your own. But if there's one thing that the above poster is correct about, it's that it probably wouldn't be worth pursuing.
