Cfw vs being banned

Hi all
What are the general rules on having custom firmware vs being banned?

Back in my xbox 360 days if u were playing online there was always a chance of being banned despite what u did

Whats the situation like with a modded switch?
 
Merely *connecting* to Nintendo's servers with any trace of a non-official digital game can get you banned. This is not just pirated goods, but also your own dumped carts, or even homebrew NSPs or links. As mentioned its any trace, so merely deleting this stuff from your library isn't enough.

Additionally, any kind of cheats or even save restore in select Nintendo multiplayer games, depending on which ones are monitored. Again actually playing online isn't necessarily required to earn a ban.

What most people seem to get away with; running homebrew via album or title replacement. You can enjoy homebrew apps and emulators, or system plugins like overclocking and temp monitors. Just do not install any NSPs in the process, and mind the cheating.

If you want to do the first two things though, you will want to block access to Nintendo servers. Easiest way is via editing exosphere.ini to make your prodinfo (unique system identifier) appear blank. You can look into emuNAND tutorials if you want one part of your system for messing around with, and another part that is clean for safely going online.

Im guessing thats the same as having wifi on the switch and that above method stops u playing online?

Gosh u can pretty much do what u want on the modded wii u lol

Any form of blocking nintendo (90dns, incognito_rcm, exosphere, etc.) Will solely block any form of connection to nintendo while still being able to use the internet.

Example, there's a homebrew that will allow you to download themes from a site. Well even with the blocks to nintendo, you still can use that homebrew to down your themes
 
Yeah and note that any official software must go through Nintendos servers at some point to work online. So with blocked prodinfo you effectively only have internet for homebrew, or a handful of cracked apps like youtube. Or you can look into the LAN-over-internet type services for some games.

Noob rule is:

Sysnand (keep 100% clean at all times) - OK to Ninty and play Online
Emunand (assume dirty at all times) - NOT ok to ever connect to Ninty
