If I were to allow friends to see what I am playing ( this is recommended to be turned off ) how long do you think it would take before my system received a ban?
 
My input would be reliant on how long you'll be "broadcasting" a homebrew/custom .cia for Nintendo to detect it.
Can't share a confirmed timing, but I would highly advise against it.

it is suspected, but still unconfirmed if that's the reason why the whole ban wave happened, in my case I had spotpass and "allow friends to see what I'm playing" turned on, I have homebrew apps, developer apps and out of region games, and played online with a pirate copy pokemon moon and never got banned.

Don't quote me on this, but it looks like normally you can play online just fine. I do this regularly and haven't gotten banned yet.
 
I just wouldn't. Say for example, you forgot to turn it off and loaded an application that clearly indicated CFW. Yeah rip.
