Hacking Question Can installing exfat driver without system update make me banned?

I'm on 4.1.0 without exfat driver.
I didn't know that I have to update firmware to the latest to get exfat driver.

I searched how to install exfat driver without system update and got how to do it.

But is it safe? I think Nintendo knows I installed it with official way or not.

Is there anyone got banned only with this situation?

No one knows for sure how safe it is, or what will happen, but report back here when you're banned.

Chances are Nintendo are keeping tabs on who has contacted their servers and legitimately obtained the update, this will be how they pay MS for the license. Whether they use that information for banning purposes is an unknown at this point.
