Gaming Can banned Switches subscribe?

Here's something that I have been wondering, now that the online service has launched: If someone has a system that has been banned from the previous free online service, can that player get it unbanned by buying the new online subscription? Or will they be unable to buy it forever. If so, wouldn't that be a way to miss money from someone who wants to go straight? What are your thoughts?

if it's like sony or microsoft, nintendo won't care since you broke the rules. they may actually find it cathartic to see people with thousands of dollars invested, only to have it snuffed out due to having used cfw. the means for it don't matter. we're all called pirates no matter was done.
 
From Nintendo’s support page:




    • Access the Nintendo eShop on your primary console and deactivate the console for your Nintendo Account from the user menu.
      • If you do not have access to the original console, you can also deactivate a primary console off-device once per year.
      • Off-device deactivations can be done by visiting accounts.nintendo.com, selecting "Shop Menu", and then "Deregister Primary Console".
 
if people subscribe while using SX OS/custom fw than they're just asking for trouble :P
Obviously, but I only use that stuff offline, and online is OFW only. Had my SX Pro since launch, and no ban yet because i'm careful. All they have on me is error logs.
