Homebrew Question Banned from activating Smash Ultimate?

So my friend is having an issue with his hacked switch: A few days before, he downloaded the early version of Smash Ultimate. Today, he was banned overnight so he couldn'a activate Smash Ultimate (If he tries to start the game, the switch checks if the game is already playable, then tells him he is banned and he gets the error code 2181-4008). So my question: Is there any way to active Smash Ultimate because the game is really expensive and Nintendo doesn't want to help him or give him the money back. He only was using LayeredFS offline for Odyssey Custom Maps, installed Custom NSPs (no pirated games), FTPD and Homebrew Appstore, all in Airplane-Mode or with custom DNS. We used the TugGer Kosmos Packs V Oh Johnny and Sparkle. So my question: Is there any way to activate the game? (I'm not asking for a way to unban him, just to unlock the game, e.g. with header editing (If this is even possible), savefile editing, nand backuo editing or other homebrew apps?)

Indeed, doesn't matter what "little" thing he did. He messed with Nintendo's hardware, and that's the price for doing it on the Switch.

Honestly he should just find the game as an NSP online, or he can trying dumping the game itself, without the update? Which I'm assuming the Day One Patch is the culprit since early copies didn't have this issue for banned Switches.

i don't understand what you mean by activating the game, i never heard of an activation for a game.
 
Think there are no method, but this situation is interesting i think you can sue nintendo but im not a lawyer

No, you cannot. To even use the Switch, you agreed to the End User License Agreement with explicitly states that you will not do anything to modify games or the console. Because that was done, Nintendo has every right to issue a ban. You can see that here: https://www.nintendo.com/consumer/info/en_na/docs.jsp

Specifically:

License Grant/Restrictions:
You may not publish, copy, modify, reverse engineer, lease, rent, decompile, disassemble, distribute, offer for sale, or create derivative works of any portion of the Software, or bypass, modify, defeat, tamper with, or circumvent any of the functions or protections of the Console, unless otherwise permitted by law. Content obtained through the use of an unauthorized device, or through the unauthorized modification of Console hardware or software, may be removed. You agree not to use the Console in an unlawful manner or to access the consoles, devices, accounts, or data of others (including Nintendo) without their (or our) consent.

And:

Updates:
After the Console is updated or changed (including without limitation in connection with an Update), any existing or future unauthorized modification of the Console or Software, or the use of an unauthorized device in connection with the Console, may render the Console and/or Software permanently unusable.

Even if you could sue Nintendo, good luck. They'll drag it out so long you'll end up in debt and drop the lawsuit.

Short answer: No

Long Answer: He needs a personalized ticket downloaded from Nintendo to unlock his preload. He’s never going to get it now. Only way to play it is to pirate the game now. He can inject a forged ticket with homebrew to unlock his preload so he doesn’t have to re-download and install again but he’d only be able to play when booted into CFW.
 
Yeah the pirated version is the only way to go unless he buys a new clean switch, this is interesting since I haven't activated my paid eshop copy yet due to sxos 6.2 compatibility. 90% of the time when ppl get banned they dont exactly tell the whole story on what they did. Clearing logs is usually the culprit if you been under the radar. Ive lost count to how many times I've seen ppl in the ban thread clear their logs not knowing it caused their ban
