If I somehow get it repaired from nintendo, will i lose my data?

ok... What about on pilot wings resort, where accounts are mii based. If i make another mii (not looking similar) with same name will i lose data on the game?

Luckily some of your save data is on your SD, and I wouldn't know if Pilotwings just transfers the mii or saves it on the cartridge.
So I can't answer that one.

Last question. If nintendo don't repair due to r4, I have warranty on it which i bought for 2 years.
If i drop it down the stairs do they HAVE to repair it for me?

Plus do you think this is due to r4 at all? After all it started once i put wireless on and turned on pokedex. That's when spotpass would have kicked in...

Warranty does not cover owner mistakes, insurance does.

You have a 1 year warranty at wherever the system was purchased by default as provided by the Sale of Goods Act (study this act, it'll be your best friend) and if I recall correctly you have a 3 year warranty with Nintendo under the same act, same goes for all electronics. You need to prove it's a manufacturing defect and therefore 'not suitable for the purpose it was sold for' and not the result of abuse to the system. Using a flashcard would constitute abuse of the system and invalidate your rights.

I've made use of the Sale of Goods Act before when there are disputes about return policies. Dropping its name normally makes most places shit bricks. Learn the terms of the Act and you'll be much better off.

I found this

If a consumer chooses to request a repair or replacement, then for the first six months after purchase it will be for the retailer to prove the goods did conform to contract (e.g. were not inherently faulty)

The 3ds was not 'inherently' faulty was it? It just came about to be so...

I've heard about this issue on IGN'S nintendo podcast, the person had to send it back.

wasn't that around April though? That error came about while playing rayman or ghost recon. I don't have either of the two and the system update was meant to fix that. I am on latest firmware.

Plus my problem doesn't just persist WHILE playing a game, it prevents me from accessing one. Or anything to be honest...

New thing i found. If i put it in sleep mode, when i open it it still acts as though it is in sleep. The blue light is still going brighter and darker. So I have to hold the power and it turns off...

I dont think the R4 did anything, I just think its a defective system.
