Having said that, if we choose to interpret his words in the best possible light, it could mean that he hates carrying cartridges around and would rather have all his games on a singe MicroSD card or not play them at all due to a bad case of OCD. I kind of doubt it though.

If that were the case, wouldn't he had something along the lines of "Wow, hope Ol' Ninty sure coordinates their retail-games-on-eShop program well!" or at least say a backup device or something. Saying piracy device is blatantly stating his/her intentions - to pirate without paying or having any intention to. That's how I interpret it at least. Maybe he didn't choose the right words or maybe he thought we'd ridicule him for saying "backup device". (lolyoudontmeanbackup)

This is the second time my ignorance of digital distribution methods has caused a post of mine to not make sense. I should probably pay more attention to that in the future. Anyway, so that I don't make two off-topic posts in the same thread:
I look forward to seeing where this goes. I'm never against being able to play retro games on another device, even if it's Tetris on my TI-89 (don't tell me I'm the only person who did this during high school!).

I guess you're right CFW wouldn't be useful to normal 3ds user atm, but could be used for developing reasons by advanced users for whatever reasons they may have.
"There is no loophole" if there wasn't the firmware couldn't be extracted in the first place, if you can extract it you can inject it with the same method. It's just not something a normal person is willing to do with their video game

EDIT: Injecting CFW is possible but it problably involves really expensive equipment, vast knowledge and the risk of bricking your 3ds (I see that many people actually have their hopes up)
