I hope they don't turn back for the people who uptaded their consoles.
They could do sort downgrade or something via software to us.

Im really kind "desperate" now on this topic, oh god, why you let me uptade??

Imo this is the same situation as with the PS3. The device can be hacked on <4.5 firmware versions but not above because the exploit has been fixed. And there won't be a CFW or flashcard for later FW versions for awhile or perhaps never. Gateway and those cheap clone makers promising working on later FW versions is just marketing. Imagine they tell you anything above 4.5 will never work. So the hunt starts for early 3DS models and when the stock is sold out we will see them on ebay or the amazon marketplace for 300 - 500 bucks. The trend will likely go to owning 1 3DS for CFW/flashcard and another 3DS for eShop and online since there is a chance that CFW/flashcard consoles will be banned.

nintendo could turn around and make some check to see if the firmware running from nand or SD. Most likely the first step they will take against this. They could turn around and make game patch for say pokemon that forces people to upgrade to the new firmware also and that new firmware has latest protection. Many ways to block the CFW for online use anyway.

They could turn around and make game patch for say pokemon that forces people to upgrade to the new firmware also and that new firmware has latest protection. Many ways to block the CFW for online use anyway.
I don't know if they care this much... Thinking about the Wii side.

Likely not, once the cheating happens on games like pokemon (well mainly pokemon lets be honest) hope is lost. Soon as pokebank opens the game will change forever anyway with hacked pokemon coming from black/white saves.

They will do stuff for future games though for sure. Might be simple you need to be on firmware X to play the new game.. and then same as above it checks to see where firmware is running from.

my opinion is that everything can be hacked its just a matter of time. i do think the 3ds will be hacked all the way but we need to wait. flashcard market is very big. its cheap to make the cards and they can sell them for a high price and we will buy them.

So do you think in a future they'll came up with an tool to really block the online from CFW/FC?

smea's would need one card once. Gateway requires one card once to install and then the other card every single time you want to use it. Plus smea's will work with any $5 3DS (4.5) compatible flash card, not some $80 card or whatever Gateway are charging.

Accept smea is against piracy so he is never going to give you 3DS rom's runnign from the 3DS SD card even if he 'unlocks' it for himself. The best you are going to get is an Emulated Nand (like gateway) that lets you run a newer Nand on an older 4.5 machine and the 'possibility' of homebrew or unsigned code. Meanwhile Gateway is working on multi-rom, Nand save games, direct save to SD card, and other goodies as well. Smea's not going to release anything useful for you people any time soon so keep dreaming....meanwhile I bet we have v2.0 gateway update within the next few days/weeks.

Then don't update the 3DS if you get one. It's not really that hard to understand that you can prevent the block by not updating the console ;)

That's surely an alternative. But what about when the games require a firmware that can't be NAND emulated? That's when people are starting to get out of luck.
