Hardware New 3ds xl top screen flickering with 3d turned on

I got myself a n3ds xl and noticed that when I turn the 3d effect on and move my head left and right, the top screen flickers. I tried turning off power saving and auto-brightness, but that didn't seem to affect anything. 2d mode doesn't flicker at all. Is this the super stable 3d mode at work? Also, the 3d image takes a second or two to readjust when I move my head.

Did you ever modified the [ SysNAND / 3DS firmware ] by doing a Decrypt9(WIP) CTRTransfer or Lazarus3DS?
