To protect yourself from nintendo issuing a ban on you, put this as your 3ds's background:

(All joking aside, to truly protect yourself from a ban, get another 3ds to hack and keep the friendcodeseed safe. Then, if you get banned, you can just switch the friendcodeseeds. That's what I have set up in case I get banned, which I haven't yet and I'm using unofficial .cia files while connected to internet and all that jazz. Just have a back up plan, and don't worry so much about it. Pokemon't the only game to care about the online parts of anyway imho.)

If you didn't protect your 3ds with incognito mode before you hacked it,chances are its too late and you are already on Nintendo's banlist that will happen in a random wave.

I think incognito mode does not work, on the Recent ban eave thread, they said they sniffed the wifi network where the 3DS is connected and it seems Nintendo does not check the game Log.

Probably.. idk.

All you are doing when you turn on incognito mode and turn off spotpass is decrease the alternative information that Nintendo can check if recorded.According to a few users on anoughter banning thread,Nintendo can collect information just by simply leaving your wifi on since it automatically connects to specific servers. We may be able to block these servers automatically in a cfw update but possibly at the cost of online multiplayer.

Lets Hope we can Block those servers on an update, it would be very nice be free and play eveything with spotpass on.

Your answer is not valid, we are talking about not being banned after pirate activity. We already know that.
That's bullshit, stop being a dick.

Nothing about your post definitively says you're are talking about not being banned after pirate activity.

I'm really trying to not use cias, I'm masking my download and play app to use the homebrew launcher, but for example free shop only works on CIA and installed.
The only hint is your mentioning of freeshop. Even then, it's specifically being cited as an example of a homebrew app that is only available as a .cia (which has since been proven wrong).

Im asking because i want to know experiences from averyone.
averyone's (sic) experiences have already been conveyed to you. You're looking for an answer that doesn't exist, and you being a dismissive dick to everyone won't change that.

The game was given to testers before actual release. Those beta copies got leaked to the public.
Not true by a long shot, they were simply pre-release retail copies.

"Don't let Nintendo ban you. Just ban yourself"
Seriously though that's basically what is happening. And if you don't care about playing online then why care about getting banned?
While I agree with your sentiments, there's a pretty enormous difference between the two.

Someone who disables wifi can simply switch it back on when and if they need wifi access. Someone who has been banned would have to jump through a number of hoops to unban yourself should they wish to use an online feature again.

But as I said, I agree with your sentiments. Nintendo's actions only ban you from using online features, so by playing with your wifi disabled you've effectively banned yourself.

Except people with NO pirated games and just homebrew also got banned but yeah keep telling people only piracy leads to bans...
Both pirated games and homebrew fall into the unauthorized software category.Since Nintendo can see what you are using, there isn't much of a difference between piracy and homebrew at this point.

That wasn't his argument. He said that bans were from piracy.

And there is a difference between Homebrew and piracy. One is legal (with caveats) and one is definitely not legal.

Both can get you banned from nintendo's servers, but there is a difference.

The answer "not pirate" if i dont want to Be banned is not valid, since i already did a modifiction on my device. Im asking how can i protect miself, if im asking is because i already did it.

Even if i want to play homebrew or something is ilegal for them.

Homebrew is legal, but both homebrew and piracy get you banned on your 3ds so it doesn't seem like there is much of a difference if both get you banned.
