AMSTERDAM - The court in Amsterdam has declared a 15-year old student innocent after he had send messages to the prime minister of the Netherlands, Jan Peter Balkenende. In the message he threatened him and said he wanted to kill him.
This is what ICT-jurist Arnoud Engelfriet reported about tuesday in his blog.
The student had send the message in early 2009 through a social network called 'hyves'.
The contents of the message in Dutch were: “ey bolle vet zak met je kanker bolle kanker bril je gaat died bitch ik kom je halen”.
(which roughly translated means:'hey fat ass with your f@$%ng fat glasses, you're going to die bitch i'm gonna get you')
Fear
The court has declared the boy innocent because there was no reason for fear. The prime ministers life wasn't really in danger after all.
Because of the words the boy used, the fact that it came from a social network site and the message contained around 15 'smileys', the court found enough reason to declare the student innocent.
Engelfriet, specialised in internetrights, said that you can only call this a thread if the reciever of the message really feels threatened. 'That wasn't the case here: it was only a 'krabbel' and it was full of smileys, nobody can take that seriously.
The 15-year old student has said he's sorry and apologised in front of the court.
At first, the court had declared the boy guilty.
