Data save transfer possible from banned switch to non-hacked switch possible ?

Hello,
I would like to know if this is possible to transfer save data from my banned switch on atmosphere to a new switch (non hacked) ?

I pre-ordered the oled and I decided to not hack it.

Can't you just use "Transfer Your Save Data" in the switch Data Management menu?

Yes, save data transfer should work, but only if it isn't banned. I'm legit, and I think when I did that with a new switch, it made me update and sign in.

Not without hacking if one is banned.

I did it with a acnh file and i didn't get banned but i dont now if it's 100% safe
