Hacking Has anyone ever been banned for using lakka?

I did some searching on this and could not find a definitive answer.
I did see plenty of people claiming you cant be banned because lakka is loaded up before horizon, therefore as long as you swap sd cards there should be no way for nin to tell you ran it.
But i remember reading a while back that after booting from rcm mode it triggers a flag somewhere and people have been banned for that.
So which is it? Does anyone here actually know anyone or had their switches banned, just for running lakka and thats it.

Actually, I don't know if anyone has been banned for Lakka either. However, it should be virtually impossible to be banned for using it since Lakka runs outside of the Switch's NAND meaning it is undetectable by Nintendo.

I did look in the banning hub, and unless i missed it (which is possible, i am a idiot), I actually havent been able to find anything about anyone being banned for lakka.
But i swore a while back I heard people complaining about being banned just for running the rcm proof of concept payload because it changes some kind of bit related to rcm mode. But I havent actually been able to find anyone who can claim they been banned just for using lakka, I have seen a few people like me though, who would be willing to only run lakka for now as long as there is not a "probable" chance of being banned, (as always i know there is a very slight chance any time you do anything)
Because of the recent lakka update Im willing to test it out as it seems to be relatively safe.

"Booted from RCM" is supposedly a detectable flag (I distinctly remember @rajkosto making a post confirming this, but I can't seem to find that post anymore... strangely the only post I can find now relevant to this topic is this).
But no, people haven't been confirmed to have been banned ONLY from just this.

Just like how having a mismatched number of burned fuses is theoretically detectable, but people haven't been confirmed to have been banned ONLY for that.

Also, this "booted from RCM" flag, the way I understand it, is not a permanent flag. It resets for each boot.
i.e. if you load Hekate, then boot into stock, this flag is turned on, and THEORETICALLY detectable.
BUT if you load Hekate, choose power off, then restart normally, then this flag should then be turned off.

Otherwise EVERYONE who loaded any CFW even ONCE (or even just loaded Hekate, to say backup their NAND) would be detected.

Note: I am just going by what I remember from discussion of users who know the actual technical details behind this. Not from personal knowledge.

I've been searching for that post I mentioned earlier, but I found this post instead about a "boot reason" value:
By the way, upstream hekate included clearing of boot reason.
This is important to have, otherwise, Switch OS will know that you booted from RCM.
So yeah, it should not be persistent across reboots.

It's impossible I guess, you are booting on Linux distribution (not Horizon OS), so no connection to N servers and don't use the console certificates on her connection.

There was a dude that got banned just by enetering rcm if i recall correctly

That sounds like a bunch of lies. Because lets say you drop your Switch and the NAND happen to pop out, that shouldn't be a bannable offense.
