If you are banned, yes you can't update through Nintendo server.

Try going online with a game that has online feature, like Pokemon.

I have been told that might work.... But this thing will probably just go back into the closet where it belongs. I would say the trash, but my little sister uses it.

Please don't throw away a (physically) perfectly fine n3DSXL.

It just needs some love and attention in fixing its software boo-boos.

Try the sysUpdater and/or CTRTransfer methods before calling quits.

Well back to updating part, you can try the sysupdater, then there is the option of CTR Transfer. Would be really suck if you CTR Transfer and then you still can't update.

Just do the 11.8 with Sysupdater.

Those *.cia files in the firmware package are put in the updates folder placed in the SD root. Avoid using FBI to install those system title CIAs.

Other than that, I recommend turning off your WiFi and using the CIA version of sysUpdater. Not sure how the *.3dsx one interacts with Homebrew Launcher injected in one the System Titles when updating.

If your firmware update goes through, use FBI to Delete Title And Ticket for sysUpdater and then Cthulhu to cache clear everything.

tbh, its probably banned because I never deleted the tickets for all of the custom homebrew that I had install previously.... sigh...

You could send your someone fc_seed or whatever it was named to see if you´re banned or you could inject a public seed
i remember playing smash 4 online with luma after the 11.8 update and im on 11.7

Totally stumped.

Maybe you're using an older version of boot9strap? Try updating to the latest v1.3.

in case you have the files working and you still get that error try ctrnand transfer
you have a n3ds frimware right?
also if posible would you be able to tell us everything you installed on that 3ds related to cfw like exploit you used to install everything, if you used gateway and the cfw you are using,etc

im using fastboot3ds, that bricked and then I got it to work again....
I just tried again and it tried to update them, said all were updated even though nothing was installed and then it rebooted???

Yea I used gateway in the past, I have luma 9.1, using fastboot3ds (this bricked my console upon install and I finally got it to "work" again.... n3ds firmware has been downloaded yes

Strange as when this happens to me, it's usually because of the home menu being modified. Have you tried installing the update cia manually?

I was told using fbi to install them would be a bad idea.
