I think the only reason they have not "yet" is to allow access to epurchased games
Also, that would block console and game updates, right? And there's something in law in several countries, where they are obliged to give you support for their product.

Reason why in many Latin American countries, which are not able to buy games on the eShop (who knows why), still have the eShop access but only for updates.

They cannot bar you from game and console updates, at all. They can ban you from their eShop if they have a good enough reason to. You can legally challenge an account ban since you paid for that content (a banned console can still be used), so I would hope they do it for grave offences.

As of right now yes. I was banned with latest firmware and still have access to eshop. I am sure they will create new TOS and have two bans levels at some point

That sounds like something they could do for real.

So, just for stating this point for sure. While they'll ban a Switch by downloading, via CDN requests, updates and so on (because the requests should include a Switch's ID), your CDN requests will still work even after the ban (right now at least, who knows in the future).

Is this right?

Your console id gets banned from using their online service. you can still access game updates and eshop but i have heard of people not able to

Alright.

The worse cases I've read are from people not having access to anything online (not even eShop), but still can update their games from the home menu.

The following weeks will be interesting.

Def... considering all the tools being used and how easily accessible they are I only see it getting worse.
They prob going to drop their hammer when they know all new units are on shelves. Will kill the scene, everyone will be looking for our version switch's

I agree.

We should really start getting more Switches right now (before new HW revisions are out) if we really want homebrew.

Now that it seems that sx os disables signatures for all installed titles. Could someone test if a game you don't own and download with this works? It's technically the same as installing an nsp but straight from ninys servers a la freeshop.

I will test later tonight. It's 4:17 PM for me in GMT-5, so it will be like in 5 hours.

I don't care about being banned. Maybe I already am.

When Nintendo gets to ban CDN requests too, I'll install every update offline via DevMenu. Not a big deal.

Just tried with Sonic Mania, didn't work
 
We need to make a fake ticket that isn't signed but has the fields correct

That's where SXOS/DevMenu come in. eXhop doesn't bypass the signature checks, that's why the game downloads and all, but doesn't open.

A absolute perfect situation is where SXOS doesn't need DevMenu to install .nsp, and simply bypasses the signature checks on everything.

SXOS's Sigbypass + eXhop = Switch's FreeShop. Downloading straight from Nintendo, installing and playing.
