So yeah, not banned here. Here is my guess:
You got banned for not having a cert in the xci/a cert not made for the game while you tried downloading the update.
The cert got sent to nintendo and they flagged you through that and banned you.
In my case, I am starting the games on sx os, then go into OFW and start the eShop and the games are being downloaded.

Not banned here and i updated my games directly in SXOS.

Your logic doesn't make sense to me. According to your example, being in SX OS or OFW doesn't matter because you state the bans are due to certificate mismatch. Cert or not, the dumps from BBB either have the same cert or they have been stripped depending on the dump. And as you mention we know certificates are matched to the game they were made for.

Have you replaced all your XCI certs? If so, were they for the exact game the XCI is for since the certs have to match the game?

What I'm getting at is that few people are going to have a matching cert for a dump because they are being pirated, meaning they didn't buy the game, meaning the don't have the correct header cert no matter what. You may be unbanned for now but it may catch up to you.

This is why I'm wondering if clearing logs will have any bearing on a ban or not. We won't know until more time goes by and someone is banned (and makes a post about it) that has been clearing their logs between each boot of SX OS and OFW.
 
I was testing this the other day.

SXOS updated all my backups via SXOS, even played games while online. Tried to connect to an online game using a backup which got the usual error. Legit game played online fine, eShop worked fine.

And today.... I can still play legit games online and still access the eShop while booted into SXOS.

I'm fully prepared to accept my ban if and when it comes.

thing is I was aways in airplane mode using layeredfs. today i booted in hekate and clearead all logs and when i booted again on horizon and tried eshop I was banned.

I only used hb with a bunch of emulators, always stayed in airplane mode. I'll check if I'm banned in a couple of minutes.

Ok, as I stated, only used HB with some emulators (such as VGA and psnes, tried desmume too). Always in airplane mode, always cleared logs before booting into OFW and I'm not banned (yet).
