They've never stopped it on wii u or 3ds, I doubt they will on switch unless it becomes so common that it tanks their servers.As of now you can download DLCs and game updates using TX payload
Even if you're banned you can still download game updates. Dunno how long Nintendo will let that continue though
I think BBB removed all the headers and identifying information from the xci's they releaseTeam Xecuter's solution is currently running cartridge dumps, not eShop dumps. Nintendo doesn't know which cartridges you've bought, since they're not tied to your console, so I'd imagine you can probably download the DLC without a problem.
That being said, if Nintendo sees the same private header online in multiple places simultaneously, they can determine that the private header belongs to a pirated copy of a cartridge. If they really wanted to measures against it, I suppose they could block you from downloading the DLC.
