I know the trial of the sword glitch has been patched with a game update recently.

I haven't got the doc.

If I was to get it now from eshop will it be the unlatched version and you have to update game to patch it.

Will l be able to use it without having to update game.

I don't think so.
I believe DLCs are updated by themselves within the eShop and you'll always download the latest update for them by default.
This is only an assumption and better personal experience would be a better confirmation.

Hi thanks for letting me know.

Would any person be able to confirm this, with actual experience of dlc being updated and patched right off the shelf to get rid of a glitch.

The game current version is 1.3 So far the dlc was released before that update, it was released with 1.2 so as long as you have that version, dlc will work.
If you download the game from eshop, you need to manually update it. It will be on initial release. Do know that you can't use save data from a later version of the game with the older version of the game. (Example, saves on 1.3 won't work with 1.0) If you do not have 1.2 then your only option is to play on 1.0 or the latest version.

Currently, you can only updated to the latest version, which the glitch was patched, or stay on what you have now. Even by swap to a new SD card would require you to re-download the games from eshops. And once you have updated the game on that console, there's no way to downgrade it even by delete them from the SD.
