I would not use shared files, but I guess it's better than nothing. How long they last?
My cousin got banned so I unbanned his console with a public LFCS_B, it lasted a few months until it was hit by the last "ban wave" (not so sure it was a ban wave at all, it may have just been the public LFCS_B that was hit), it had been public for at least a few weeks when I unbanned his 3DS with it so not too bad.

The thing about the public seeds is that as soon as more than one person uses it, it gets flagged. It's better to use one from a console you own or that someone won't use anymore. It's a matter of temp unban vs permanent unban (assuming you're smart enough to not get legitimately banned again)

There haven't really been any signs that Nintendo uses that as a criteria for bans, although it would be silly for them not to, so I see your point.
Realistically how many more years of use are our 3DSes gonna get though, and how long is the Nintendo Network service going to stay up? If I had to replace the LFCS_B every 6 months for the next 3-4 years to keep playing online that wouldn't be too bad. Now if they start having ban waves every other week that would be a problem.

i thought this would result in false bans from cartage versions of games
Cartridges have unique headers, whereas CIAs are using the console unique header, it's pretty easy to tell them apart.
That might mean that using the same private header on multiple ROMs on a flashcart might be impossible to tell apart from using the CIA version of the same games though, it depends on if they are able to differentiate between a retail copy and a CIA either by the data sent to their servers or info they already have recorded before.

Well like you said, they could just compare purchase lists against device IDs/NNIDs and ban anyone who is playing digital games that aren't in said list; but they haven't for whatever reason. In that sense they could tell if you're playing a CIA dump of a game that was only released on a cartridge... Hmm playing this game but it's using their console's header and not the cartridge when it was never released as a digital title = red flag; or should. Lol.

To the OP:

Personally, I'd say that using CIA games is no different using the one you paid for besides the legit RSA signature; which makes no difference to CFW anyway. As far as Nintendo can see (if they aren't checking your purchase history) is that you're playing the game through a cartridge or the console. I wouldn't worry too much.

As for private vs public seeds, it's also my opinion that with the "unsure" nature of these bans it's smart to use public ones until they get banned as well. You'd be mad if you used a private one and got banned again anyway, even after taking steps since no one knows what causes it. Yeah they are all banned eventually but it's not like the next day or even week. The last public seed that UnbanMii used is still good and that was uploaded June; so it's not an "OMG public seed = instaban because 10,000 people use it." Even if it's flagged it still takes them a while to ban it; months even.

There are very few people I just have just an immense dislike of and he's one of those very few people, the only other example is Gene Simmons. My musician uncle on my mother's side of the family actually met Gene once during some event and said he was the most unpleasant person to be around.
